DMCA Policy

Novino Inc. ("Novino", "we", "us", or "our") respects the intellectual property rights of others and expects users of the Pheid application (the "App") to do the same. We respond to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512) ("DMCA").

Filing a Takedown Notice
If you believe that content available through the App infringes your copyright, please send a written notice to our designated agent containing:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material that is claimed to be infringing, with enough detail for us to locate it (for example, the channel name and approximate date of the message)
- Your contact information, including name, address, telephone number, and email address
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf
Counter-Notice
If you believe your content was removed by mistake or misidentification, you may file a counter-notice with our designated agent containing:
- Your physical or electronic signature
- Identification of the material that was removed and the location where it appeared before removal
- A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification
- Your name, address, and telephone number
- A statement that you consent to the jurisdiction of the federal court in your district (or Montreal, Quebec, Canada if you are outside the United States) and that you will accept service of process from the person who filed the original notice
Process
Upon receiving a valid takedown notice, we will:
- Remove or disable access to the allegedly infringing content
- Notify the user who posted the content
- Provide the user an opportunity to file a counter-notice
If we receive a valid counter-notice, we will forward it to the original complainant and restore the content within 10-14 business days unless the complainant notifies us that they have filed a court action.
Repeat Infringers
We will terminate the accounts of users who are repeat copyright infringers, in appropriate circumstances and at our sole discretion.
